1. Acceptance of Terms

By accessing and using VelocityCart's website (getvelocitycart.com) and purchasing or using our digital products and services, including "The Operator's Guide to Ecommerce Growth" eBook and our monthly subscription service, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services or make a purchase.

These terms, together with our Privacy Policy and Refund Policy, form the complete agreement between you and VelocityCart.

2. Description of Services

VelocityCart offers the following digital products and services:

2.1 The Operator's Guide to Ecommerce Growth eBook

Price: A$39.00 (one-time purchase, Australian dollars)
Format: Digital eBook (PDF)
Delivery: Email download link sent immediately after payment
License: Personal use only (see Section 7: Intellectual Property)

2.2 Monthly Subscription Service

Price: A$19.00 per month (Australian dollars)
Renewal: Automatically renews on the same date each month
Content: Access to premium content archive available on your member account
Cancellation: Can be cancelled anytime via member account page or by contacting support
Continued Access: Subscription access continues until the end of your paid billing period, even if you cancel mid-month

3. Account Creation and Authentication

3.1 Account Registration

To purchase our products, you must create an account by providing your email address. Your name is optional. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Magic Link Authentication

We use magic link email authentication for account login. When you request to log in, we send a secure, time-limited link to your email address. Click this link to access your account. Magic links expire after a short time and can only be used once.

3.3 Account Responsibility

You agree to provide accurate, current, and complete information during account registration and to keep this information up to date. You are responsible for all activities conducted through your account. If you suspect unauthorized use, contact us immediately at support@getvelocitycart.com.

4. Payment Terms

4.1 Currency and Pricing

All prices are displayed in Australian dollars (A$). Pricing may change at any time, but changes will not affect orders already placed.

4.2 Payment Processing

Payments are processed by Stripe, a secure third-party payment processor. Stripe handles all credit card data in compliance with PCI-DSS standards. VelocityCart does not store your credit card information—Stripe retains a payment reference that we use for order management and billing.

4.3 Billing and Renewals

For the eBook, your account is charged once at the time of purchase. For the subscription service, your account is charged automatically on the same date each month. You will receive an email confirmation of each charge. If a payment fails, we will attempt to retry according to your payment method's issuer policies.

4.4 Invoice and Records

You can access your payment history and invoices through your member account. Invoices include the Stripe payment reference for your records.

5. Digital Delivery and Subscription Access

5.1 eBook Delivery

Upon payment, a download link will be sent to your email address within minutes. The link contains your digital eBook file. You are responsible for downloading and storing this file securely. VelocityCart provides the link for a limited time; if the link expires, you can request a new one through your account or by contacting support@getvelocitycart.com.

5.2 Subscription Access

Subscription members can log in to their account to access the premium content archive. Access is provided for the duration of your paid subscription period. Your content access will continue until the end of your current billing period, even if you cancel your subscription mid-month.

5.3 Cancellation and Access Rights

You can cancel your subscription at any time via your member account page or by emailing support@getvelocitycart.com with your email address. Cancellation takes effect immediately, but you retain access to all content until the end of your paid billing period. No partial refunds are issued for unused portions of a billing period.

6. Technical Requirements and Compatibility

The eBook is provided as a PDF file and is compatible with standard PDF readers available on most devices (computers, tablets, smartphones). Subscription content is accessed via a web browser and is compatible with all modern browsers (Chrome, Firefox, Safari, Edge, etc.).

You are responsible for maintaining a compatible device and software. VelocityCart is not responsible for compatibility issues arising from outdated software or unsupported devices.

7. Intellectual Property Rights

7.1 Ownership

All content provided by VelocityCart, including the eBook, subscription materials, website design, text, images, graphics, and any other materials, are owned by VelocityCart or our content licensors. All intellectual property rights are reserved.

7.2 License Grant

When you purchase the eBook or subscribe to our service, you receive a limited, non-exclusive, personal-use license to access and read the content. This license permits you to:

Download and view the eBook on your personal devices
Read and reference the content for personal learning and business purposes
Print a personal copy for your own use

7.3 Restrictions

You may not:

Share, resell, or distribute the content to others (even at no cost) without written permission
Reproduce or copy the content beyond what is permitted for personal use
Modify, adapt, translate, or create derivative works from the content
Use the content for any commercial purpose without a separate commercial license
Remove or alter copyright notices, author attributions, or proprietary markings
Use the content to train AI models or extract data for machine learning purposes

7.4 Breach of Intellectual Property Rights

Unauthorized use of content may result in legal action and termination of your access without refund. VelocityCart actively monitors for unauthorized distribution and infringement.

8. Prohibited Uses

You agree not to use VelocityCart's services or content in any way that is unlawful, harmful, or violates these terms. Prohibited uses include, but are not limited to:

Violating any applicable laws or regulations
Infringing on anyone else's intellectual property or privacy rights
Harassing, defaming, or threatening others
Attempting to gain unauthorized access to our systems or accounts
Disrupting or interfering with website functionality or security
Uploading malware, viruses, or harmful code
Using our service for spam, phishing, or fraudulent purposes
Distributing or reselling purchased content without authorization
Scraping or automated data collection without permission
Circumventing security measures or access controls

VelocityCart reserves the right to investigate violations, suspend or terminate accounts, and pursue legal action as appropriate.

9. Disclaimers and Limitation of Liability

9.1 "As-Is" Service

VelocityCart provides content and services on an "as-is" basis without warranties of any kind, express or implied. We make no warranty that content is error-free, complete, or suitable for any particular purpose.

9.2 No Professional Advice

The content provided by VelocityCart is educational material and general business guidance. It is not professional advice, and you should not rely on it as a substitute for advice from qualified professionals (accountants, lawyers, business consultants, etc.). Always consult with appropriate professionals before making business decisions.

9.3 Limitation of Liability

To the maximum extent permitted by law, VelocityCart is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, even if we have been advised of the possibility of such damages. This includes loss of profits, loss of data, or business interruption.

9.4 Total Liability

VelocityCart's total liability for any claim arising from your purchase or use of our services is limited to the amount you paid for the product or service in question.

9.5 Availability and Interruptions

We strive to maintain continuous website and subscription access. However, we do not guarantee uninterrupted service. VelocityCart is not liable for unavailability due to maintenance, technical issues, server problems, or third-party service outages (including hosting providers, Supabase, or Stripe).

10. Australian Consumer Law and Consumer Guarantees

10.1 Australian Consumer Law Rights

Nothing in these terms excludes, restricts, or modifies rights you have under the Australian Consumer Law (Competition and Consumer Act 2010) that cannot be excluded.

10.2 Consumer Guarantees

You have statutory guarantees under the Australian Consumer Law. For digital products, these include guarantees that:

Goods are of acceptable quality
Goods fit for purpose
Goods are as described
Services are provided with due care and skill
Services are provided within a reasonable time
Services are fit for purpose

10.3 Remedy Rights

If our digital products or services fail to meet consumer guarantees, you may be entitled to remedies such as repair, replacement, or refund depending on the nature and severity of the failure. See our Refund Policy for details on how to claim remedies.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles.

11.2 Jurisdiction

Both you and VelocityCart consent to the exclusive jurisdiction of the courts of Australia to resolve any disputes arising from these terms or your use of our services.

11.3 Dispute Resolution

Before pursuing legal action, we encourage you to contact us at support@getvelocitycart.com to resolve any disputes informally. If we cannot resolve the matter within 30 days, either party may pursue legal remedies available under Australian law.

12. Changes to Terms of Service

VelocityCart may modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following the posting of revised terms constitutes your acceptance of the changes.

For material changes, we will provide notice via email to the address associated with your account if you are a subscriber.

13. Termination

13.1 Your Right to Cancel

You can cancel your subscription at any time via your member account or by contacting support@getvelocitycart.com. Access will continue until the end of your paid billing period.

13.2 VelocityCart's Right to Terminate

VelocityCart reserves the right to suspend or terminate your account if you breach these terms, engage in prohibited uses, or violate applicable laws. Account termination may result in loss of access to your content without refund.
